Terms of Service
These Terms of Service (the "Terms") govern your use of the California Disaster Rebuilding Portal (the "Portal"). The Portal is operated by Home Rebuild Network, program partners, participating lenders, and technology providers, including Prudent AI. By using the Portal, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not submit information through the Portal.
1 Purpose of the Portal
The Portal provides disaster-recovery information and routes requests. It may compare the information you provide with participating lender program criteria for rebuilding financing. There is no fee to submit a request through the Portal.
2 The Portal is not a lender or adviser
The Portal Operator, California MBA and Prudent AI are not acting through the Portal as your lender, mortgage broker, loan servicer, financial adviser, legal adviser, tax adviser, credit counselor, or insurance adviser. Portal information is general and does not replace advice from a qualified professional who understands your circumstances.
3 Initial intake is not a loan application
The Portal's initial rebuilding intake is not a loan application. The Portal does not itself pull your credit, underwrite a loan, approve or deny credit, set loan terms, or commit funds. If you are matched with a participating lender, you may be redirected to that lender's separate application process and point-of-sale system. The lender is solely responsible for its application, underwriting, disclosures, decisions, rates, fees, and terms.
4 No guarantee and no endorsement
Submitting information does not guarantee a lender match, loan approval, particular rate or payment, state-supported assistance, insurance recovery, or any other outcome. Program requirements, funding, lender participation, and eligibility may change. A match, listing, or referral does not constitute an endorsement, recommendation, or warranty by the State of California, California MBA, or the Portal Operator.
5 Your responsibilities
You agree to:
- provide information that is accurate and complete to the best of your knowledge;
- submit information only for yourself or for another person when you have legal authority to act for that person;
- review information and documents before submission and avoid including information the Portal has not requested;
- protect any access credentials and promptly report suspected unauthorized use;
- review and comply with the terms and notices of any lender, servicer, subservicer, agency, or third-party service you use; and
- confirm material decisions directly with the lender, servicer, subservicer, agency, insurer, or qualified adviser responsible for them.
6 Permission to route your request
When you submit a request and provide the required consent, you authorize the Portal to collect the information you provide, evaluate it for routing purposes, disclose it to a matched participating lender, and allow that entity to contact you about next steps. Any separate consent to calls, text messages, automated dialing, or prerecorded messages must be presented clearly at the point where that consent is requested.
7 Prohibited conduct
You may not:
- use the Portal for unlawful, fraudulent, deceptive, or abusive activity;
- submit another person's information without authority;
- attempt to gain unauthorized access to the Portal or another user's information;
- interfere with security, availability, or operation of the Portal;
- introduce malicious code, scrape the Portal at scale, or use automated means except as expressly permitted; or
- misrepresent an affiliation with the Portal, California MBA, a public agency, lender, servicer, or program partner.
8 Third-party services
The Portal may link or redirect you to services operated by lenders, government agencies, insurers, or other third parties. Those services have their own terms, privacy practices, security controls, and accessibility features. We are not responsible for third-party content or decisions, except to the extent required by law.
9 Portal content and intellectual property
The Portal and its original content, design, and software are protected by applicable intellectual-property laws. You may use Portal information for your personal disaster-recovery needs. You may not copy, modify, sell, license, or commercially exploit Portal content except with written permission or as otherwise allowed by law. Names, logos, and marks belong to their respective owners.
10 Availability and changes
We may update, suspend, or discontinue any part of the Portal, including available programs and participating entities. We work to keep information current but do not promise that every item is complete, error-free, or available at all times. If the Portal is unavailable or your matter is time-sensitive, contact your lender, servicer, subservicer, insurer, or appropriate public agency directly. The Portal is not an emergency service.
11 Disclaimers
To the fullest extent permitted by law, the Portal and its content are provided "as is" and "as available" without warranties of any kind, express or implied. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12 Limitation of liability
To the fullest extent permitted by law, the Portal Operator and supporting entities will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Portal, a routing or matching result, a third-party decision, or unauthorized access beyond their reasonable control. This limitation does not apply where prohibited by law and does not limit liability that cannot legally be limited.
13 Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
14 Changes to these Terms
We may update these Terms as the Portal, law, or program changes. We will post the revised Terms and update the effective date. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
